STR Regulations for Independence, Virginia

Important note on scope: Independence is an incorporated town within Grayson County. You will find county-level information (permits, taxes, contacts) and state-level safety and building requirements that govern STRs in Virginia. Where a topic has no town-specific rule (e.g., no separate town occupancy tax or permitting framework), the guide defaults to state-level provisions.

1) Overview: Are STRs allowed in Independence, VA?

  • Yes, short-term rentals are allowed in Independence, VA. The primary local framework is set by Grayson County’s permitting and taxation systems. While there is no published town-specific STR licensing code, STR operations are generally permitted as an accessory or principal use within the building and zoning context that applies to the subject property.
  • Grayson County offers a countywide Transient Occupancy Tax (TOT) program and provides forms and instructions for direct bookings (see Section 5 and Section 7 links).
  • Virginia has statewide building and life-safety codes that govern all dwellings offered for short-term lodging (see Section 5).

2) How to start an STR business in Independence/Grayson County

Step 1 — Property readiness and compliance

  • Confirm the subject is a lawful dwelling unit that meets the Virginia Uniform Statewide Building Code (VUSBC). Bedrooms must have adequate egress (one exterior door or a code-compliant window) and smoke/CO detection as required by state law (see Section 5).
  • Ensure compliant cooking and sanitation facilities as per the VUSBC.
  • Utilities must be separately metered and safe for occupancy. Confirm adequate parking and site access. Follow stormwater, erosion/sediment control, and disposal rules for any disturbed land.
  • If using accessory structures (e.g., detached cabins) verify they are permitted as Accessory Uses (Accessory Use must meet district standards; if no Cooking, the structure is considered “Accessory” and can be offered as sleeping quarters; if Cooking is included, a Conditional Use Permit may be required; see Section 5).

Step 2 — Business tax registration and TOT setup

  • Register with the Virginia Department of Revenue for state tax accounts (sales/use and employer withholding as applicable) and for any local business license if required by your business model. Note: Virginia does not require a state-level business license.
  • If you will accept direct bookings (e.g., Airbnb/Vrbo not collecting/remitting), register with Grayson County Tourism for the Transient Occupancy Tax (TOT) and set up monthly remittance. If your bookings are processed by platforms that collect TOT for Grayson County, verify the platform’s remittance status with Grayson County Tourism.

Step 3 — Host responsibilities and transparency

  • Post an STR safety card in each unit: emergency numbers, exit routes, and the owner’s 24/7 contact. Provide a quiet hours policy and a trash/recycling plan consistent with local service areas.
  • Keep an STR guest log for at least 3 years: guest name, dates of stay, number of occupants, room/unit number, and total charges. Some municipalities require this; Virginia does not require a guest log, but it is highly recommended for insurance, safety, and tax audit readiness.

Step 4 — Listing and marketing compliance

  • Include your TOT registration number (if applicable), maximum occupancy, and any quiet-hours or parking rules in your listing.
  • Use accurate photos and descriptions. For properties in a homeowners association (HOA), confirm STRs are permitted by the HOA and your insurance policy.

Step 5 — Ongoing operations

  • File and remit TOT monthly (or per Grayson County schedule). Monitor property insurance, building code compliance, and neighboring impacts (noise, parking).
  • Ensure periodic inspection/permit renewals as required by Grayson County Building Permits (see Section 6).
  • Track state and local code updates and respond to any future town or county STR ordinances or tax changes.

3) Documents, Permits, Licenses, Guidelines — what you likely need

  • Business/Tax

    • Virginia Department of Revenue registration (sales/use tax and employer withholding as applicable).
    • Grayson County TOT registration (direct booking) and monthly remittance (see Section 7 links).
    • If you use the property as a lodging business (separate from your residence), consider a local business license if your business model requires it; Virginia has no state-level business license requirement.
  • Building/Life Safety

    • Virginia Uniform Statewide Building Code (VUSBC) compliance for all dwellings and sleeping rooms.
    • Smoke detectors and carbon monoxide alarms per Virginia Code (see Section 5).
    • Fire safety guidance for short-term lodging is provided by the Virginia Department of Fire Programs (see Section 5).
  • Health/Environment

    • Onsite sewage disposal (septic) must be permitted and in good standing with the Virginia Department of Health for the property.
    • Water/wastewater compliance varies by site; work with the Grayson County Health Department and Building Department.
  • Zoning/Use

    • Verify the principal STR use and any accessory structures comply with the district requirements that apply to the property. For details on accessory uses and conditional use requirements, see Section 5.
  • Grayson County Tourism

    • TOT forms and instructions, and tourism zone application and ordinance information (see Section 7).

4) City-, County-, and State-level regulations (what’s in force now)

  • City (Independence, VA)

    • No separate town-specific STR licensing or permitting ordinance was published in the provided sources. The town falls within the county’s administrative structure for permits and taxes; unless Independence adopts a future STR-specific ordinance, use the county and state guidance below.
  • Grayson County

    • Transient Occupancy Tax (TOT): Grayson County collects TOT with forms and procedures published by Tourism (see Section 7). Some platforms collect on behalf of hosts; for direct bookings, hosts must register and remit TOT directly.
    • Building Permits and Zoning Administration: Grayson County administers VUSBC and building permits; zoning rules and administrative procedures (including conditional uses and variances) are governed by the county’s zoning ordinance (see Section 5). If using accessory structures with cooking facilities or hosting unrelated guests in accessory buildings, a Conditional Use Permit may be required (see Section 5).
  • State of Virginia

    • Virginia Uniform Statewide Building Code (VUSBC): Every dwelling unit used for lodging must meet the code’s structural, life safety, and habitability standards.
    • Smoke Detectors and Carbon Monoxide Alarms: Mandatory installation and maintenance per Virginia law (see Virginia Code 36-99 et seq., fire prevention and safety; see Section 5).
    • State lodging/occupancy taxes: Virginia localities may levy lodging taxes; in Grayson County, the primary lodging tax is the county TOT (see Section 7).
    • For properties with sprinkler systems, refer to the Virginia Residential Code/Fire Sprinkler Act for thresholds (see Section 5).

5) State-level codes and guidance (for STR safety and compliance)

  • Virginia Uniform Statewide Building Code (VUSBC)

    • Statutory authority: Virginia Code Title 36 (Emergency Services and Safety) and related regulations; the VUSBC applies statewide and governs construction, alteration, and occupancy.
    • Key implications for STRs: VUSBC requires compliant egress, structural integrity, and habitability. If a building is substandard or lacks required permits, it may not be offered as lodging. If converting rooms or accessory structures to STR use, verify zoning and building code compliance and, where applicable, obtain a certificate of occupancy.
  • Smoke Detectors and Carbon Monoxide Alarms

    • Virginia Code Title 36, Chapter 6 (fire prevention and safety) requires smoke detectors and CO alarms in dwellings; hosts must ensure detectors are installed, maintained, and functional in STR units.
  • Fire Safety Guidance

    • Virginia Department of Fire Programs (VDFP) publishes guidance on fire safety for lodging and residential occupancies. Hosts should review VDFP materials and ensure exit routes, electrical safety, and emergency information are present and current.
  • Zoning Compliance

    • Accessory Uses and Conditional Uses: Under typical zoning frameworks, Accessory Uses (e.g., detached sleeping quarters without cooking) may be permitted if they meet district standards; however, if cooking or independent sanitation is provided in an accessory structure, a Conditional Use Permit may be required, subject to the review of the Board of Supervisors. Hosts should consult the Zoning Administrator and Building Department early (see Section 6).

It is situated on Virginia's Crooked Road, a heritage trail celebrating the musical heritage of Southwest Virginia. The market uses a timber-frame, white oak, pavilion completed in 2021 in collalboration with the Timber Framers Guild. Remaining work includes bathrooms, utilities and sitework — as well as a stage. The stage hosts Farmers Market as well as Crooked Road events and is named the Uncle Wade Old Time Stage, after noted musician and Independence native, Wade Ward.
